STAND Flagpoles Affiliate Program Terms and Conditions1. Agreement

By signing up for the STAND Flagpoles Affiliate Program, you are agreeing to comply with and be bound by the following terms and conditions. Please read this agreement carefully before registering and participating as an affiliate. If you do not agree to these terms, you should not register.

2. Affiliate Eligibility

To join the STAND Flagpoles Affiliate Program, you must be at least 18 years of age and have a valid PayPal account. We reserve the right to approve or reject any affiliate application at our sole discretion. We may cancel your affiliate status if we determine that your participation violates these terms.

3. Commissions

As a registered affiliate, you will earn a commission of 10% on all qualifying sales generated through your unique affiliate link. Sales are only considered valid if:

• The customer uses your affiliate link to complete their purchase on our website.
• The transaction is completed and payment is received in full.
• The order is not canceled, refunded, or returned within the designated return period.

Example: If a customer purchases our Roosevelt Flagpole for $329 through your referral link, you will earn $32.90 (10% of $329).

4. Payment Terms

Payments will be made via PayPal. Affiliates will receive their commissions on a monthly basis, within the first week of each new month, for all qualifying sales made in the previous month. The minimum payout threshold is $50. If your commissions do not reach this threshold, the balance will carry over to the next month.

Annual Earning Cap: Affiliates can earn up to a maximum of $500 per calendar year. If your earnings exceed $500 in a year, you will be required to submit a W-9 tax form in accordance with U.S. tax law. Once the W-9 is submitted and verified, you may continue earning commissions beyond the $500 limit.

Affiliates are responsible for ensuring that their PayPal account information is accurate. We are not liable for any incorrect payment information provided by affiliates.

5. Affiliate Responsibilities

As a STAND Flagpoles affiliate, you agree to:

• Promote STAND Flagpoles products in a truthful and ethical manner.
• Refrain from any misleading, deceptive, or harmful advertising.
• Avoid spamming, unsolicited emails, or any marketing methods that violate applicable laws and regulations.
• Ensure that your affiliate link is used in accordance with these terms.

You must not misrepresent your relationship with STAND Flagpoles or imply that you are an official spokesperson or employee of the company.

6. Prohibited Activities

Affiliates are prohibited from engaging in the following activities:

• Purchasing products through your own affiliate link for personal gain.
• Engaging in fraudulent activities or manipulating tracking to increase commissions.
• Using paid advertising, including pay-per-click (PPC) campaigns, that direct traffic to STAND Flagpoles using your affiliate link.
• Creating websites, social media accounts, or domains that impersonate STAND Flagpoles or infringe upon our trademarks.

Violating any of the above restrictions may result in immediate termination of your affiliate account and forfeiture of any earned commissions.

7. Tax Requirements

If your total earnings exceed $500 in a calendar year, U.S. law requires us to collect a W-9 tax form before we can release additional commissions. You will be notified once your earnings approach the $500 limit, and no further payments will be made until the W-9 form is submitted and verified.

For affiliates outside the United States, compliance with your country’s tax regulations is your responsibility.

8. Termination

STAND Flagpoles reserves the right to terminate your affiliate account at any time for any reason, including breach of these terms. If your account is terminated, you will no longer be eligible to earn commissions, and any unpaid commissions may be forfeited at our discretion.

You may also terminate this agreement at any time by notifying us in writing. If you terminate the agreement, you will no longer be entitled to future commissions.

9. Modification

STAND Flagpoles reserves the right to modify or update these terms and conditions at any time. Affiliates will be notified of any changes via email or through the affiliate dashboard. Continued participation in the affiliate program after any modifications constitutes your acceptance of the revised terms.

10. Liability

STAND Flagpoles is not liable for any indirect, special, or consequential damages resulting from your participation in the affiliate program, including any loss of revenue, profits, or data. We make no warranties or guarantees regarding the success or profitability of your participation in the affiliate program.

11. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from or relating to this agreement shall be resolved in the courts of the United States.

12. Acceptance of Terms

By registering for the STAND Flagpoles Affiliate Program, you acknowledge that you have read and agree to these terms and conditions.

STANDFLAGPOLES® is a brand owned and operated by MGO Global Inc.  MGO Global Inc. and our affiliated entities (together “MGO”, “we” or “us”) provides this privacy policy ( “Privacy Policy”) to inform users about our procedures regarding the collection, use, processing, deletion, security, and disclosure of personal data and information that is subject to protection under applicable data protection, data privacy and data security laws, including the California Consumer Privacy Act (as amended, the “CCPA”) and the General Data Protection Regulation (EU) 2016/679 (the “GDPR”) (such data and information collectively, “Personal Data”) received from users of the websites owned and operated by MGO, including those found at  https://standflagpoles.com/, https://www.libertyoutdoor.com/, and https://passportlighting.com/ (collectively, the “Website”) and received from other persons or entities that have entered into written agreements with us that expressly reference this Privacy Policy (as applicable). We may also process additional categories of Personal Data which we receive from our customers during the pre-purchase, purchase or post purchase interactions.

We are committed to ensuring that we process your Personal Data in accordance with applicable data protection legislation and privacy and data security laws. Your use of the Website means that you accept and understand this Privacy Policy. Please do not use the Website or provide us with any Personal Data if you do not accept this Privacy Policy.

MGO may from time to time update this Privacy Policy by posting an updated version to the Website. The date on which this Privacy Policy was last updated is set forth above. Your use of the Website after any updated version is posted means that you accept and understand such updated Privacy Policy. In addition, the Website makes use of cookies as described in further detail below.

1. Information Collected

Personal data is requested from you whenever you place an order, create and account, register to join our mailing list or any type of membership, contact our Customer Service team, sign up for our marketing communications, browse our website or otherwise provide us with Personal Data in connection with the Website. Once you have opted to provide the requested information the data will include your given name and surname, email address, telephone number, and your shipping and billing addresses among others. We also collect data regarding your shopping habits and the pages and products you have browsed from your use of our website. Examples of the data collected from you are included below:

1. We process the personal data required to complete and dispatch your purchase, including your name, billing address, delivery address, payment details, mobile number, telephone number and email address. We collect your email address in order to send you confirmation of your order; we collect your telephone number so that we can contact you if there are any issues with the order.
2. We collect your email address when you sign up to receive information from MGO.
3. If you register for an account with any of our brands at MGO, we collect your name, email address, country and additional data regarding your marketing preferences.
4. When you contact our Customer Service team, we may collect additional data to help us resolve any queries relating to your order, delivery, payments, marketing, the website or any other queries.
5. We collect and process data about your browsing on the Website, including the pages you visit and how you interact with these pages. If you have registered for an account, we collect browsing data about your access to the dedicated areas of the website.
6. If you are a customer of MGO, or if you have given us your consent, we collect and process your personal data for direct marketing activities and other purposes, across all MGO´s brands.
7. If you provide us with someone else's data - for example, if you purchase a product to be delivered to a friend or as a gift - we will collect and process the personal data required to complete the transaction such as the name, delivery address and other contact details for your friend. 
8. When you contact our Customer Service team, your interactions may be recorded for training and fraud prevention purposes.

 

Also, in connection with operating the Website, we obtain your Personal Data from the following sources:

• Information from your communications with us in connection with the Website or other services, events, publications or programs that we are offering, including any updates to such information provided by you;
• Information captured on the Website, including information provided by you through online forms and any information captured via cookies;
• Information that you provide us at the start of our interactions with you, or during the course of us providing services to you;
• Information that you provide us in conjunction with your application for employment; and

Your information will be processed by MGO as the data controller and may also be transferred across the other company’s part of MGO to help operate our business efficiently. 

3. With whom we share your Personal Data

We do not sell or rent any of the Personal Data we collect about you to third parties. We do not disclose any Personal Data about you to third parties, except: (i) as permitted or required by law or regulation or pursuant to any legal process; (ii) in response to governmental, regulatory, law enforcement or judicial inquiries; (iii) to affiliates to provide and develop our services, combining information internally across other MGO affiliates where we have operations to help our services be more relevant and useful to you and others; (iv) to third party suppliers and service providers (including vendors providing hosting, database management and development services related to the operation of the Website, outsourcing providers of our back-office and internal functions, technology service providers, and/or email marketing services related to events we are hosting, our publications or other communications we may send to you); (v) with our consultants, auditors and other professional advisors; and (vi) entities to whom we may transfer, or merge parts of our business or our assets in a restructuring or in connection with a corporate transaction. If a change happens to our business, then the successor entity may use your Personal Data in the same way as set out in this Privacy Policy. Within the last twelve (12) months, we have shared with affiliates and service providers Personal Data collected in connection with the Website. 4.  Transfer of Personal Data Under the GDPR

The Personal Data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA") where a third party identified in Section 3 (“With whom we share your Personal Data”) is located outside of the EEA. Where such transfers take place, they are made in accordance with this Privacy Policy and in accordance with applicable data protection legislation. We are not responsible for the content or privacy practices of such third-party websites or any products or services offered through them or the confidentiality, use, processing and security of any Personal Data that you provide to such websites.

6. Data subject rights under European data protection legislation

This Section 8 is relevant to you to the extent that your Personal Data is protected by the GDPR or equivalent European data protection legislation. For the purposes of applicable data protection laws in the European Economic Area, including the GDPR, each MGO entity will be a data controller of any Personal Data collected by us. In simple terms, this means that we: (i) “control” your personal data, including making sure that it is kept secure; and (ii) make certain decisions on how to use and protect your Personal Data, but only to the extent that we have informed you about the use or such use is otherwise permitted by law. Special Categories of Personal Data: We may collect special categories of Personal Data about you for which we act as a data controller when we collect Personal Data in this manner. Special categories of Personal Data may include certain demographic information about you such as race, ethnicity and sexual orientation. For example, we may collect information about your race, ethnicity and sexual orientation when you apply for a job with us if you choose to disclose such information. We may also collect information about prior criminal convictions and offences in connection with your application for employment with MGO, and other special categories of Personal Data as part of background checks that we conduct on job applicants and/or customers and as part of providing services on behalf of our customers. If you provide us with, or we collect, any special categories of Personal Data, or criminal conviction data, on yourself, we will separately ask you for consent before we agree to the processing of such Personal Data.

Data Retention: We will retain your Personal Data only for so long as we need the Personal Data for the purposes it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required under applicable law or requested by you. To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.

When you request our mobile services, we may keep your mobile phone number, the make and model of your phone, the operating system used by your phone and details of your network operator, and we will link a unique identifier to your mobile phone number. We'll store your device language, app language, and country. We need this information in order to provide the features and services enabled through our mobile services and to administer our mobile service.

If you follow us or interact with us on any of our pages on third party social media platforms, such as Instagram, Facebook and other social media platforms, the information you provide will be subject to the third party's privacy policy, as well as this Privacy Policy.

9. Marketing – Opt In/Out Provisions

We offer you the chance to receive news and communications from us which, depending on your preferences, we will send to you via email, SMS and/or direct mail. You must opt in to these communications, which include alerts for new products, features, enhancements, special offers, upgrade opportunities, contests, events of interest, and one-off marketing promotions. You can also opt-out of receiving these updates, if you wish. If you opt in, we, or our third-party business partners, may send you marketing materials if you enter a promotion or attend an event thrown or sponsored by us. 10. Our commitment to data security

We consider the protection of Personal Data to be a sound business practice, and to that end we employ commercially appropriate organizational, physical, technical and procedural safeguards and measures to protect your Personal Data in our possession or under our control, to the extent possible, from unauthorized or accidental access and improper use. Unfortunately, the transmission of information via the Internet is not completely secure, and we cannot guarantee the security of your Personal Data transmitted to or through the Website; any such transmission is at your own risk. We will notify you in writing and provide an explanation if we cannot comply with a specific request.

Disclosure and Access Rights: You have the right to request that we disclose to you certain information regarding our collection and use of Personal Data specific to you over the last twelve (12) months. Such information includes: a) The categories of Personal Data we collected about you; b) The categories of sources from which the Personal Data was collected; c) Our business or commercial purpose for collecting such Personal Data; d) The categories of third parties with whom we share the Personal Data; e) The specific pieces of Personal Data we collected about you; and f) Whether we disclosed your Personal Data to a third party, and, if yes, the categories of Personal Data that each recipient obtained.

No Discrimination: We will not discriminate against you for exercising your rights under the CCPA, including by denying service, suggesting that you will receive, or charging, different rates for services or suggesting that you will receive, or providing, a different level or quality of service to you.

How to Exercise Your Rights: To exercise any of your rights under the CCPA or to access this notice in an alternative format, please submit a request on your behalf using any of the methods set forth in Section 13 (“Contact”) of this Privacy Policy below.

12. Our commitment to children's privacy

We do not seek to collect or maintain information (including Personal Data) on the Website from those we know are under the age of 18, and no part of the Website is structured to attract anyone under the age of 13. If we learn we have collected or received Personal Data from an individual under the age of 13, we will delete that Personal Data.

If you are submitting a request pursuant to the GDPR, CCPA or other data protection laws, we will contact you to confirm receipt of your request and request any additional information necessary to verify your request (which may include verification of the requestor’s identity ourselves or using a third-party service). We verify requests by matching information provided in connection with your request to information contained in our records. Depending on the sensitivity of the request and the varying levels of risk in responding to such request (for example, the risk of responding to a fraudulent or malicious request), we may request further information in order to verify your request. We also reserve the right to verify your request through a third-party verification service. You may designate an authorized agent to make a request under the CCPA on your behalf, provided that you satisfy certain requirements set forth in the CCPA for such authorized agent to make a request on your behalf. We may verify such authorized person’s identity using the procedures above.

This Privacy Policy may undergo changes and additions from time to time. Where possible we will inform you of any changes, but please check the contents periodically.
